1. Overview

By accessing our website and/or purchasing from us, you engage in our Service and agree to be bound by these Terms, including any policies referenced or linked within. These Terms apply to all users, including browsers, vendors, customers, merchants, and content contributors.

Please read these Terms carefully. If you do not agree, you may not use our website or services. Any new features, products, or updates will also be subject to these Terms. We reserve the right to modify these Terms at any time by posting updates on this page. Your continued use of our site means you accept any changes.

Our store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products and services.

2. Eligibility & User Accounts

By using FITHUB services, you confirm that you are at least the age of majority in your country, state, or province of residence.

FITHUB products are not intended for minors under 16 years old. If you are between 16-18 years old, you must have a legal guardian’s consent before using our products and services.

You are responsible for maintaining the confidentiality of your account information and agree to notify us immediately of any unauthorized access.

FITHUB is not responsible for any loss or damage arising from failure to comply with these security obligations.

3. Product Information & Pricing

We strive to accurately display product details, descriptions, and pricing. However, we do not guarantee that all information is free from errors.

We reserve the right to modify product pricing at any time without prior notice.

Certain products may be available exclusively online and have limited stock.

All product descriptions, pricing, and availability are subject to change at any time.

4. Order Processing, Shipping, and Cancellations

Orders are typically processed within 2-3 business days, but this may vary based on demand.

Shipping takes approximately 6-8 weeks, as products are shipped via LTL Freight for secure delivery.

Orders can be canceled within 48 hours of purchase. A 5-10% processing fee will be deducted for administrative costs.

Appointment delivery process – Please ensure you provide accurate contact information at time of order, as this information will be used by the freight carrier to contact you BEFORE delivery to schedule a specific appointment time. You must be home during this appointment window.

Standard delivery process – Standard curbside delivery is provided for all orders. The carrier will unload the shipment at the end of your driveway.

Inside delivery process – Inside delivery is available for an additional “$$”. The carrier will bring the shipment through the first threshold, which is typically the garage.

White glove delivery – White glove delivery will include full setup of your product in a room of your choice and removal of all packaging.

Accessibility – In rare circumstances, your street may be too narrow for the delivery truck to reach you. If you suspect this will be an issue, please notify us in advance so we can make the right accommodations.

Damages/claims – If you suspect your shipment to be damaged, you are entitled to inspect the product with the driver present. You should also not accept the delivery and mark the BOL notating the specific damage.

5. Returns & Refunds

You have 14 days from the date of delivery to request a return.

Items must be unused, in their original packaging, and include all accessories.

 15% restocking fee applies to any returns due to the costs incurred during the fulfillment stage. 

  Customers are responsible for return shipping costs.

If a returned product is used, damaged, or missing components, no refund will be issued, and the product will be sent back to the customer.

6. Limited Warranty

FITHUB products come with a 1-year limited manufacturer’s warranty covering defects in materials and workmanship only.

The warranty does not cover:

Normal wear and tear

Damage caused by misuse, improper installation, or unauthorized modifications

Electrical issues resulting from improper setup or power surges

Customers must provide proof of purchase for any warranty claim.

FITHUB reserves the right to repair, replace, or issue a partial refund at our discretion.

Risk of Loss, Damage, or Theft During Shipping

Once your order leaves our facility and is handed over to the carrier, the risk of loss, damage, or theft transfers to you. We are not responsible for any issues that occur during shipping. If your shipment is damaged in transit, we may assist you in filing a claim with the carrier, but the responsibility for the product rests with you once it departs from our facility.

To protect your purchase, we offer optional shipping insurance through a third party company called "ROUTE" to cover your order in case of loss, theft, or damage during transit. If you choose not to purchase shipping insurance, you assume all risks associated with potential shipping issues. We strongly recommend selecting this coverage to safeguard your investment.

7. Liability Disclaimer and Usage Guidelines

Assumption of Risk

• Use of this equipment involves risk of physical injury, disability, or death.

• By using the FITHUB Titan Max, you voluntarily accept all risk and waive any claims against the seller for injury or damages.

• You agree to use the machine only as directed and assume full responsibility for any misuse.

Proper Use and Maintenance

• For indoor use only. Do not place or operate the machine outdoors, in a garage, or in any area exposed to rain, humidity, or extreme temperatures.

• Do not use the machine if any parts appear damaged or if it is not operating properly.

• Do not modify, disassemble, or attempt repairs unless performed by an authorized technician.

Mirror and Arm Safety

• Do not strike, hit, or bang the mirror surface under any circumstance.

• Do not lift, pull, or move the machine by its arms.

• When moving the machine, always cover the mirror and arms with padded protection to avoid injury or damage.

Health Considerations

• Consult with a doctor before beginning any exercise program, especially if you have a history of heart conditions, joint issues, or other medical concerns.

• Do not use the machine if you are pregnant or under the influence of alcohol, medications, or drugs without first consulting a physician.

• Stop using the machine immediately if you experience pain, dizziness, or shortness of breath.

• This machine is not a substitute for professional fitness or medical advice.

Age and Supervision

• This machine is intended for use by adults only.

• Keep children and pets away at all times.

• Do not leave the machine unattended while in use or powered on.

Limitation of Liability

• FITHUB is not responsible for any injuries, damages, or losses resulting from the use or misuse of our products.

• Customers assume full responsibility for ensuring proper use, installation, and maintenance of all products.

• In no event shall FITHUB, its employees, affiliates, or suppliers be liable for indirect, incidental, punitive, or consequential damages, including loss of profits, property damage, or medical costs.

• FITHUB’s total liability shall not exceed the original purchase price of the product.

• You agree to release, indemnify, and hold harmless the seller, manufacturer, and affiliates from any claims, losses, or legal actions related to your use of the equipment.

Force Majeure

FITHUB is not liable for any delays, losses, or failures caused by events beyond our reasonable control. These may include, but are not limited to, natural disasters, supply chain disruptions, labor shortages, shipping delays, pandemics, or government regulations.

8. Prohibited Conduct

Users are strictly prohibited from:

Using FITHUB services for any illegal, fraudulent, or unauthorized activity.

Attempting to reverse engineer, modify, or hack FITHUB software, hardware, or digital services.

Distributing malware, spam, or engaging in cyberattacks.

Using FITHUB products in a way that violates any applicable laws, regulations, or third-party rights.

FITHUB reserves the right to suspend or terminate your access for violating these terms.

9. Intellectual Property

All trademarks, logos, product designs, website content, and technology used by FITHUB remain the exclusive property of FITHUB.

Customers may not copy, reproduce, distribute, or modify any content without prior written permission.

10. Disclaimers

FITHUB services and products are provided “as is” without any express or implied warranties.

We do not guarantee that the FITHUB website or services will always be uninterrupted, secure, or error-free.

FITHUB is not liable for any inaccuracies, delays, or errors in content, pricing, or service availability.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Oregon, without regard to conflict of law principles.

Any disputes must first be resolved through informal negotiation.

If unresolved, disputes shall be subject to binding arbitration under the American Arbitration Association (AAA) in Portland Oregon.

By agreeing to these Terms, you waive your right to participate in a class action lawsuit.

12a. Changes to Terms

We reserve the right to modify these Terms at any time.

Any updates will be posted on this page, and it is your responsibility to review them regularly.

Your continued use of the site after modifications constitutes acceptance of the new Terms.

12b. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be considered severable and will not affect the validity and enforceability of any remaining provisions.
